This Contest is subject to all applicable federal, state and local laws.
ELIGIBILITY. The Contest is open to legal residents of the continental United States (Alaska and Hawaii are excluded) that are (a) at least eighteen (18) years of age as of the date of entry and (b) have a valid email address and are registered users of Facebook, Twitter or Instagram (each fully eligible person a “Participant”). No anonymous users will be eligible. Employees (and their spouses, children, siblings, parents, grandparents and grandchildren) of Sponsor, the College Football Playoff, ESPN, its franchisees, subsidiaries, affiliates, and advertising or promotional agencies are not eligible to participate. There is no fee or charge to become a registered Facebook, Twitter or Instagram user; however, doing so is subject to terms and conditions of Facebook, Twitter, or Instagram as applicable, over which Sponsor has no control. Throughout the website, you will find plenty of opportunities to earn social rewards by sharing about your National Championship experience on social media and by checking in at venues throughout Tampa Bay. HOW TO ENTER. The Contest begins on December 26, 2016 at 12:00:00 pm Eastern Standard Time (“EST”) and ends on January 8, 2017 at 4:59:59 pm EST (the “Entry Period”). To enter the contest, download the CFP Social Passport – Tampa Bay App beginning December 26, 2017 and register using the Participant’s Facebook account information. Once a Participant has successfully downloaded the App, the Participant must complete the described social actions to receive the corresponding point values. As an alternative form of entry, participants may also mail in a self-addressed card to the Tampa Bay Sports Commission (see sponsor section of rules). Prizes will be available based on meeting the total point value requirements for each prize level. Finally, a Participant must complete all registration information in the official App and agree to these Official Rules by checking the box;
This Contest is in no way sponsored, endorsed or administered by, or associated with, the College Football Playoff, Facebook, Twitter or Instagram and any questions, comments or complaints regarding this Contest shall be directed to Sponsor and not to the College Football Playoff, Facebook, Twitter or Instagram. Sponsor’s posting of a Submitted Photo, Post or Video to the Host Website does not constitute a final determination that the Submitted Photo, Post or Video complies with the Entry Guidelines or these Official Rules. Submitting a Submitted Photo, Post or Video constitutes Participant’s certification that he/she meets the eligibility requirements set forth in these Official Rules and entrants will have to agree to the Official Rules when finalizing entry. Sponsor reserves the right to verify eligibility of any potential winner. Winning a prize is contingent upon a Participant’s fulfilling all requirements in these Official Rules. All Submitted Photos, Posts and Videos must be received by 4:59 p.m. E.T. on January 8, 2017. Sponsor reserves the right to allow for minor discrepancies between the Participant’s timing device and the actual runtime of the Submitted Photo, Post or Video on the App.
By submitting a Submitted Photo, Post or Video in the Contest, you hereby warrant and represent that your entry conforms to the following entry requirements set forth herein (“Entry Requirements”):
- Submitted Photos, Posts and Videos must comply with these Official Rules and any Terms of Service in the App;
- Submitted Photos, Posts and Videos must be the original work of the Participant and may not have won previous awards or have been published previously;
- Submitted Photos, Posts and Videos cannot be sexually explicit or suggestive, unnecessarily violent or derogatory of any ethnic, racial, gender, religious, professional or age group, profane or pornographic, contain nudity or any materially dangerous activity;
- Submitted Photos, Posts and Videos cannot promote alcohol, illegal drugs, tobacco, firearms/weapons (or the use of any of the foregoing), any activities that may appear unsafe or dangerous, or any particular political agenda or message;
- Submitted Photos, Posts and Videos cannot be obscene or offensive, endorse any form of hate or hate group;
- Submitted Photos, Posts and Videos cannot defame, misrepresent or contain disparaging remarks about Sponsor or its products, or other people, products or companies;
- Submitted Photos, Posts and Videos cannot contain trademarks, logos or trade dress owned by others, or advertise or promote any brand or product of any kind, without permission, or contain any personal identification, such as license plate numbers, personal names, e-mail addresses or street addresses;
- Submitted Photos, Posts and Videos cannot contain copyrighted materials owned by others (including photographs, sculptures, paintings and other works of art or images published on or in websites, television, movies or other media) without permission; Sponsor does not permit the infringement of others’ rights and any use of materials not original to the entrant (except copyrighted materials owned by Sponsor) is grounds for disqualification from the Contest. Do not copy your favorite movie, book or photo or include materials, images, graphics, music or trademarks belonging to any third parties or incorporate the names, voices, likeness or personas of any party other than yourself unless you have obtained all rights necessary to permit you to use same in connection with your Submitted Photos, Posts and Videos and grant the rights herein granted to Sponsor;
- No background artwork should appear in a Submitted Photos, Posts and Videos unless it is an original work of the entrant. Any artwork, murals, etc. that can be seen in Entries must be created solely by the entrant or entrant must be the sole owner of all copyright interests therein;
- Submitted Photos, Posts and Videos cannot contain materials embodying the names, likenesses, photographs, or other indicia identifying any person, living or dead, without permission;
- Submitted Photos, Posts and Videos cannot communicate messages or images inconsistent with the positive images and/or goodwill to which Sponsor wishes to associate; and
- Submitted Photos, Posts and Videos cannot depict, and cannot themselves, be in violation of any law.
Any Participant whose work includes likenesses of third parties or contains elements not owned by the entrant (such as, but not limited to, depictions of persons, buildings, trademarks or logos) must be able to provide legal releases for such use including Sponsor’s use of such Submitted Photo, Post or Submitted Video, in a form satisfactory to Sponsor, upon request, prior to award of prize and/or naming of Participant as a Winner.
By entering a Submitted Photo, Post or Submitted Video, Participant represents and warrants that he/she possesses the rights and/or consents to all the materials used therein. Participant further grants to Sponsor a non-exclusive, perpetual, assignable, world-wide, royalty-free license to publish, reproduce, distribute, display, perform, create derivative works, transmit or disseminate the Submitted Photo, Submitted Post and/or Submitted Video in all media or platforms whether now known or hereafter invented. Submitted Photos, Submitted Post and Submitted Videos become property of the Sponsor and will not be returned.
SUBMITTED PHOTOS, POSTS OR VIDEOS POSTED VIA THE APP WERE NOT EDITED BY SPONSOR AND ARE THE VIEWS/OPINIONS OF THE INDIVIDUAL PARTICIPANT AND DO NOT REFLECT THE VIEWS OF SPONSOR IN ANY MANNER. Any waiver of any obligation hereunder by Sponsor does not constitute a general waiver of any obligation to Participants.
Sponsor reserves the right to waive the Contest entry requirements set forth herein in its reasonable discretion. Sponsor reserves the right, in its reasonable discretion, during or upon completion of the Entry Period, to request that any Participant resubmit his or her Submitted Photo, Submitted Post or Submitted Video which fails to comply with the Contest entry requirements prior to any judging or voting period.
By submitting a Submitted Photo, Submitted Post or Submitted Video, you agree that your submission is gratuitous and made without restriction, and will not place Sponsor under any obligation, that Sponsor is free to disclose or otherwise disclose the ideas contained in the Submitted Photo or Submitted Video on a non-confidential basis to anyone or otherwise use the ideas without any additional compensation to you. You acknowledge that, by acceptance of your submission, Sponsor does not waive any rights to use similar or related ideas previously known to Sponsor, or developed by its employees, or obtained from sources other than you.
Sponsor reserves the right to, and may or may not, monitor/screen Submitted Photos, Submitted Posts or Submitted Videos prior to posting them to the App. By entering, you acknowledge that Sponsor has no obligation to use or post any Submitted Photo, Submitted Post or Submitted Video you submit.
If you are selected as a winner, your information may also be included in a publicly-available winner’s list.
SELECTION OF WINNER. Sponsor will review total accumulated points for each participant throughout the length of the contest, beginning Monday, December 26, 2016. Once the entry deadline expires (January 8, 2017 at 4:59:59 pm EST), points can no longer be earned. Points can only be earned between December 26, 2016 at 12:00:00 pm EST and January 8, 2017 at 4:59:59 pm EST. Participants must be in attendance at the College Football Playoff National Championship in Tampa Bay to receive prizes. Prizes will not be shipped. Prizes can be claimed at MacDill Park (i.e. Social Village) on the Tampa Riverwalk on an ongoing basis on Saturday, January 7th and Sunday, January 8th, from noon to 7pm each day. All prizes must be picked up in person. Contest will also feature random prize drawings on Saturday, January 7th and Sunday, January 8, where each participant will have the opportunity to scan his or her wristband and/or mobile device at select activations for a chance to win contest prizes. Winners of the random drawing will be selected at random. Contest participants who earn 7,500 points will automatically qualify to enter a separate scan to win contest, located at the Thuzi tent within MacDill Park (i.e. Social Village) along the Riverwalk, for a chance to win two tickets to the national championship game on Monday, January 9, 2017. The winner of the scan to win for national championship game tickets will be selected at random. A minimum of 7,500 points must be earned in order to qualify and participate in this separate scan to win contest. Game Sponsor will not pay airfare, accommodations, travel, or any other expense, including shipping and handling, for participants to claim prizes. In addition to prizes, Sponsor will randomly select one overall “Grand Prize” winner for one pair of tickets to the 2017 College Football Playoff National Championship at Raymond James Stadium on January 9, 2017. Ability to earn points can be capped for specific actions for the entirety of the contest and per day. For the purposes of this Contest, a “day” is defined as each 24 hour period during the Entry Period beginning at 12:00:00 EST and ending at 11:59:59 pm EST. Automated methods of earning points are prohibited. Any attempt by Participant and/or his/her family/friends to earn additional points using multiple names or email addresses and/or any other fraudulent mechanism (including hiring third parties to submit Votes), as determined by Sponsor in its sole discretion, shall give Sponsor the right to disqualify Participant in its reasonable discretion. Potential winners are subject to verification, including verification of age. The decisions of the Sponsor, including the verification of the prize winner, will be final and binding on all matters relating to the Contest. The winner will be notified by U.S. Mail and/or email or in person, at the Sponsor’s election, on or around January 8 of his or her selection as winner. If the prize notification is returned as undeliverable or the prize cannot be awarded to the selected winner for any reason, the prize will be forfeited. Sponsor is not responsible for any change of email address, mailing address and/or telephone number of entrants.
PRIZES. Prizes can be redeemed on an ongoing basis on Saturday, January 7th and Sunday, January 8th, from noon to 7pm each day. Participants will have the opportunity to select their prizes based on the number of points they earn. For example, if a participant were to earn 14,000 total points, that participant would have the choice to select the commemorative football (14,000 point value) or a combination of the championship hat (6,500 points) and the championship t-shirt (7,500 points), which together combine to equal 14,000 points. Prize selections do not need to equal total points earned, however they cannot exceed total points earned. In this example, if you have earned 14,000 total points, you could elect to redeem for a lapel pin (4,500 points) and a championship hat (6,500 points) for a total of 11,000 points used, thus leaving you with 3,000 points remaining. Contest will also feature random prize drawings on Saturday, January 7th and Sunday, January 8, where each participant will have the opportunity to scan his or her wristband and/or mobile device at select activations for a chance to win contest prizes. Winners of the random drawing will be selected at random. The Grand Prize Winner will receive one pair of tickets to the 2017 College Football Playoff National Championship Game on January 9, 2017 at Raymond James Stadium. One winner will be drawn from those eligible to win two tickets. Participants who earn 7,500 points, automatically qualify to enter a scan to win contest, located at the Thuzi tent within MacDill Park (i.e. Social Village) along the Riverwalk, for a chance to win two tickets to the national championship game on Monday, January 9, 2017. Winner of the scan to win for national championship game tickets will be selected at random. The Grand Prize Winner will be required to claim his or her prize by completing and signing an Affidavit of Eligibility and Release of Liability, which must be completed in person at the redemption area at MacDill Park (i.e. Social Village) on the Tampa Riverwalk either Saturday, January 7th or Sunday, January 8th between noon and 7pm. Failure of the winner to timely sign and return the required Affidavit of Eligibility and Release of Liability, or to otherwise comply with these Official Rules, will result in winner’s forfeiture of the prize, and the prize will not be awarded to a substitute winner. Prizes are non-transferable, except at the sole discretion of the Sponsor. Limit: one (1) prize per person/household. Prizes will be distributed on a first-come, first-served basis during the redemption period, while supplies last. All federal, state and local taxes on prize are the sole responsibility of winner. The winners may be required to provide Sponsor with a valid social security number or tax identification number before the prize will be awarded for tax reporting purposes. Winners will be issued an IRS 1099 form. Unclaimed prizes will be not be awarded. Prizes won by an eligible entrant who is a minor in his/her state of residence will be awarded to minor’s parent or legal guardian who must sign and return all required documents. Approximate Total Value of all prizes: $23,000.
GENERAL CONDITIONS. Sponsor’s computer is the official clock for all purposes of this Contest. By entering the Contest, each Participant (or their parent or legal guardian if an eligible minor) agrees (and agree to confirm in writing): (a) to abide and be bound by these Official Rules and the decisions of Sponsor; (b) to waive any and all claims against the Sponsor, the College Football Playoff, ESPN, its affiliates and subsidiaries, its officers, directors, employees, agents, franchisees, franchise partners, Facebook, Twitter, Instagram and its advertising and promotional agencies (“Released Parties”), with regard to losses or injuries of any kind resulting or relating to participation in the Contest, acceptance/possession/use and/or misuse of the prize, printing, mailing or distribution errors, or tampered, garbled, incomplete, lost, stolen or late illegible entries; (c) to indemnify and hold harmless Released Parties from and against any and all liability, claims, loss, damage, injury or expense, including reasonable attorney’s fees, arising in connection with any third party action arising out of a breach or allegation which if true would constitute a breach of any of Participant’s representations, warranties or obligations herein. Acceptance of the prize constitutes winner’s permission to use the winner’s name, address, biographical information and/or likeness for advertising and trade purposes (except where prohibited by law) without further compensation, worldwide and in perpetuity, by and using any and all forms of media, whether now known or hereafter devised, including without limitation the Internet. The Sponsor reserves the right to modify, suspend or terminate the Contest if, in its sole and exclusive discretion, it determines that for any reason the fairness, integrity or security of the Contest has been jeopardized or compromised if such that it cannot be conducted as originally planned. This includes by way of example and not limitation infection by computer virus, bugs, tampering, unauthorized intervention, fraud or technical failures. In such event, Sponsor will make the prize available to be won in a manner that Sponsor determines, in its sole discretion, to be fair, appropriate and consistent with these Official Rules. Notice of such action will be posted on www.facebook.com, www.twitter.com, www.instagram.com and www.TampaBay2017.com. Any person attempting to defraud or in any way tamper with or improperly influence the outcome of the Contest will be ineligible for the prize and may be prosecuted to the fullest extent of the law. All Internet access and usage charges are the sole responsibility of the Participant. Sponsor and Released Parties assume no responsibility for any error, omission, interruption, deletion, defect, delay in operation or transmission, communications line failure, theft or destruction or unauthorized access to, or alteration of, any Contest entries. Sponsor and the Released Parties are not responsible for any problems or technical malfunctions of any telephone network or lines, computer on-line systems, servers or providers, computer equipment, software, failure of any e-mail or entry to be received by Sponsor on account of technical problems or traffic congestion on the Internet or at any website, or any combination thereof, including (without limitation) any injury or damage to entrant's or any other person's computer-related to or resulting from participation or downloading any materials in this Contest. Without in any way limiting the foregoing, Sponsor expressly disclaims any and all liability for the functionality/availability of www.facebook.com, www.twitter.com, www.instagram.com, and www.TampaBay2017.com, which are independently operated by their respective owners. In the event of a dispute as to the identity of the person who submits any entry hereunder, an eligible electronic Contest entry will be considered made by the authorized owner of the registered Facebook account, registered Twitter account, registered Instagram account or registered email account that submitted the entry. Entries generated by robots or scripts or other automated devices are considered to be a direct violation of the Official Rules and the policies of this Contest and will result in the immediate and automatic disqualification from this Contest of any and all associated entries. Any attempt by an individual to deliberately damage nay website or undermine the legitimate operation of this Contest is a violation of criminal and civil laws, and should such an attempt be made, Sponsor reserves the right to seek damages from any such individual to the fullest extent permitted by law. Except as required by law, Sponsor will not share a Participant’s information with any third parties.
DISPUTE RESOLUTION/GOVERNING LAW. All issues and questions concerning the construction, validity, interpretation and enforceability of the Contest Official Rules, or the rights and obligations of Participant and Sponsor in connection with CFP Social Passport – Tampa Bay, shall be governed by, and construed in accordance with, the laws of the State of Florida, without giving effect to the conflict of laws rules thereof, and any matters or proceedings which are not subject to arbitration as set forth in of these Official Rules and/or for entering any judgment on an arbitration award, shall take place in the State of Florida, in the City of Tampa. Any such action shall be resolved individually, without resort to any form of class action, and any and all such claims, judgments and awards shall be limited to actual out-of-pocket costs incurred (if any), but NOT attorneys’ fees, with the waiver of all rights to claim punitive, special or other damages and any right to have damages multiplied or otherwise increased.
Any controversy or claim arising out of or relating to the Contest shall be settled by binding arbitration in a location determined by the arbitrator as set forth herein (provided that such location is reasonably convenient for claimant), or at such other location as may be mutually agreed upon by the parties, in accordance with the procedural rules for commercial disputes set forth in the Comprehensive Arbitration Rules and Procedures of JAMS (“JAMS Rules and Procedures”) then prevailing, and judgment upon the award rendered by the arbitrator(s) may be entered in any court having jurisdiction thereof. Whenever possible a single Arbitrator shall be used. The arbitrator shall be selected pursuant to the JAMS Rules and Procedures. The arbitrator shall apply Florida law consistent with the Federal Arbitration Act and applicable statutes of limitations, and shall honor claims of privilege recognized at law. In the event that the claimant is able to demonstrate that the costs of arbitration will be prohibitive as compared to the costs of litigation, Tampa Bay Sports Commission, Inc. will pay as much of the claimant’s filing and hearing fees in connection with the arbitration as the arbitrator deems necessary to prevent the arbitration from being cost-prohibitive. If any part of this arbitration provision is deemed to be invalid, unenforceable or illegal (other than that claims will not be arbitrated on a class or representative basis), or otherwise conflicts with the rules and procedures established by JAMS, then the balance of this arbitration provision shall remain in effect and shall be construed in accordance with its terms as if the invalid, unenforceable, illegal or conflicting provision were not contained herein. If, however, the portion that is deemed invalid, unenforceable or illegal is that claims will not be arbitrated on a class or representative basis, then the entirety of this arbitration provision shall be null and void, and neither claimant nor Tampa Bay Sports Commission shall be entitled to arbitrate their dispute. Upon filing a demand for arbitration, all parties to such arbitration shall have the right of discovery, which discovery shall be completed within sixty days after the demand for arbitration is made, unless further extended by mutual agreement of the parties. THE ARBITRATION OF DISPUTES PURSUANT TO THIS PARAGRAPH SHALL BE IN THE PARTICIPANT’S INDIVIDUAL CAPACITY, AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS OR REPRESENTATIVE PROCEEDING. THE ARBITRATOR MAY NOT CONSOLIDATE OR JOIN THE CLAIMS OF OTHER PERSONS OR PARTIES WHO MAY BE SIMILARLY SITUATED. DO NOT ENTER THIS CONTEST IF YOU DO NOT AGREE TO HAVE ANY CLAIM OR CONTROVERSY ARBITRATED IN ACCORDANCE WITH THESE OFFICIAL RULES.
BY PARTICIPATING IN THE CONTEST, EACH PARTICIPANT AGREES THAT TO THE EXTENT PERMITTED BY APPLICABLE LAW: (1) ANY AND ALL DISPUTES, CLAIMS AND CAUSES OF ACTION ARISING OUT OF OR CONNECTED WITH THE PROMOTION, OR ANY PRIZE AWARDED, WILL BE RESOLVED INDIVIDUALLY THROUGH BINDING ARBITRATION AS SET FORTH ABOVE, WITHOUT RESORT TO ANY FORM OF CLASS ACTION; (2) ANY AND ALL CLAIMS, JUDGMENTS AND AWARDS WILL BE LIMITED TO ACTUAL THIRD-PARTY, OUT-OF-POCKET COSTS INCURRED (IF ANY), BUT IN NO EVENT WILL ATTORNEYS' FEES BE AWARDED OR RECOVERABLE; (3) UNDER NO CIRCUMSTANCES WILL ANY PARTICIPANT BE PERMITTED TO OBTAIN ANY AWARD FOR, AND PARTICIPANT HEREBY KNOWINGLY AND EXPRESSLY WAIVES ALL RIGHTS TO SEEK, PUNITIVE, INCIDENTAL, CONSEQUENTIAL OR SPECIAL DAMAGES, LOST PROFITS AND/OR ANY OTHER DAMAGES, OTHER THAN ACTUAL OUT OF POCKET EXPENSES), AND/OR ANY RIGHTS TO HAVE DAMAGES MULTIPLIED OR OTHERWISE INCREASED; AND (4) PARTICIPANT'S REMEDIES ARE LIMITED TO A CLAIM FOR MONEY DAMAGES (IF ANY) AND PARTICIPANT IRREVOCABLY WAIVES ANY RIGHT TO SEEK INJUNCTIVE OR EQUITABLE RELIEF. SOME JURISDICTIONS DO NOT ALLOW THE LIMITATIONS OR EXCLUSION OF LIABILITY, SO THE ABOVE MAY NOT APPLY TO EVERY PARTICIPANT.
